1. Use of the Website
1.1 Eligibility: You must be at least 18 years old to use this Website. By accessing or using the Website, you represent that you are 18 years of age or older.
1.2 License: HVAC Quote grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Website for personal or business purposes in accordance with these Terms.

You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. 3.1 Subscription Plans: HVAC Quote offers subscription plans for access to the Website’s services. The terms and pricing of these subscription plans will be outlined during the registration process.
3.2 Billing: By subscribing to a paid plan, you authorize HVAC Quote to charge your payment method for the subscription fees. Payments will be processed according to the billing cycle you select. All fees are non-refundable unless otherwise stated.
3.3 Late Payments: If you fail to pay any fees when due, HVAC Quote may suspend or terminate your account access until the outstanding fees are paid.
3.4 30-Day Risk-Free Satisfaction Guarantee: If, for any reason, you are not fully satisfied with HVAC Quote’s software during the first thirty (30) calendar days from the date of your initial activation (“Trial Period”), you may request to cancel your subscription under this Satisfaction Guarantee. To qualify, you must deliver written notice of cancellation to HVAC Quote before the start of your second billing cycle (i.e., on or before day 30 of the Trial Period). Notice may be sent via email to zane@hvacquote.ai or through the in-app cancellation form.
4. Privacy Policy
4.1 Data Collection: HVAC Quote collects and processes personal information in accordance with its Privacy Policy. By using the Website, you consent to the collection, use, and sharing of your data as described in the Privacy Policy.
5. Limitation of Liability

6.1 Termination by You: You may terminate your use of the Website at any time by discontinuing your access to the Website and canceling any paid subscription.
6.2 Termination by HVAC Quote: HVAC Quote reserves the right to suspend or terminate your access to the Website if you breach these Terms, violate any applicable law, or engage in conduct that is harmful to the Website or its users.
7. Marketing and Promotional Use
By using HVAC Quote’s services, the Client grants HVAC Quote permission to use the Client’s name, logo, and any relevant content in marketing materials, case studies, advertisements, and other promotional content. This includes, but is not limited to, the right to display the Client’s name and logo on HVAC Quote’s website, social media platforms, and other digital or print marketing channels, for the purpose of promoting HVAC Quote’s services and attracting new clients. The Client may request the removal of their name or logo from such materials at any time by contacting HVAC Quote in writing.
8. Indemnification
You agree to indemnify, defend, and hold harmless HVAC Quote, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Website, violation of these Terms, or infringement of any third-party rights.
9. Governing Law and Dispute Resolution
9.1 Governing Law: These Terms are governed by and construed in accordance with the laws of the state of [Insert State], United States, without regard to its conflict of laws principles.

Client acknowledges and agrees that all SMS/text message marketing campaigns conducted through HVAC Quote Leads must comply with applicable federal and state laws, including but not limited to the Telephone Consumer Protection Act (TCPA), the new Texas SMS/telemarketing registration requirements (effective September 1, 2025), and any similar state-specific regulations.
Client represents and warrants that:
- All recipients of SMS/text messages have provided valid, documented consent to receive marketing communications.
- Client has obtained any required telemarketer registrations, licenses, or bonds in states where messages will be sent, including but not limited to the State of Texas, if applicable.
- Client will provide HVAC Quote with proof of registration and/or exemption upon request.
HVAC Quote acts solely as a service provider in facilitating SMS campaigns and shall not be deemed the sender or initiator of messages for purposes of compliance with federal or state telemarketing laws. Client assumes full responsibility for ensuring compliance and agrees to indemnify, defend, and hold harmless HVAC Quote, its affiliates, and personnel from and against any claims, damages, fines, penalties, attorneys’ fees, or other liabilities arising out of or related to SMS/text message marketing conducted on Client’s behalf.
11. Changes to Terms
HVAC Quote reserves the right to modify or update these Terms at any time. When we make changes, we will update the “Effective Date” at the top of this page. By continuing to use the Website after changes are made, you agree to the updated Terms.
